No charges to be issued against motorist who fell asleep, killed bicyclist in Muskego

A 20-year-old man who fell asleep at the wheel and killed a bicyclist in Muskego in July will be issued traffic citations but not charged with a criminal offense, according to a recommendation from Waukesha County Dist. Atty. Brad Schimel.

The prosecutor shared his findings earlier this week with Antoinette Gunderson, whose husband, Robert, 62, was killed while biking on Woods Rd., near Maclen Dr.

The driver in the crash, Andrew S. Yang, of Milwaukee, told police that he began to nod off as he drove to work and planned to pull over, but awoke when he hit something about 3:40 p.m. Evidence at the crash scene showed his westbound car crossed the center line, crashed head-on into Gunderson, who was riding in the eastbound lane, then collided with a utility pole.

Tom notes at the end of his blog post that District Attorney Schimel reached the same conclusion after reviewing the traffic crashes that killed Brett Netke and Jeff Littman, both in 2010. This is exactly why the Wisconsin Bike Fed is lobbying for a Vulnerable User Law. I will have more on this in a blog post here tomorrow.
